Terms of Use
Last updated
These terms are a contract between you and Brandmasters Media ("Brandmasters", "we", "us"). They cover your use of brandmastersgtm.com (the "Site") and the Brandmasters GTM platform (the "Platform"). By using either, you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it, and "you" means that company.
If you have signed a separate engagement agreement, order form or master services agreement with us, that document governs where it conflicts with these terms. See "Which document wins" below.
What the Platform is
Brandmasters GTM is a go-to-market engine we build and operate for a client. It surfaces accounts that show a buying signal, scores them against the client's ideal customer profile, verifies contact details, drafts outreach in the client's voice, and sends it across email and LinkedIn once the client has approved it.
The Platform is client-exclusive. There is no public sign-up and no self-serve plan. Access is provisioned by us during onboarding, and each workspace is configured for a single client from that client's ideal customer profile, offer and voice.
The Site is an information website. Nothing on it is an offer to contract, a warranty, or a guarantee of any commercial result.
Eligibility and accounts
The Platform is provided for business use only. It is not offered to consumers, and it is not intended for anyone under 18.
You are responsible for your account credentials and for everything done under your account. You agree to keep multi-factor authentication enabled where we provide it, not to share logins between people, and to tell us promptly at support@brandmastersmedia.com if you believe an account has been compromised.
We may suspend an account immediately where we reasonably believe it is being used in breach of these terms or our Acceptable Use Policy, or where continued use presents a security, legal or deliverability risk to you, to us, or to a third party.
Your data, and who owns what
You own your data. That includes your ideal customer profile, your offer and voice documents, your account and contact records, your message content and your results. We do not sell it, and we do not use it to build or train products for other clients.
You grant us a limited, non-exclusive licence to host, process, transmit and display that data strictly to operate the Platform for you, to support you, and to keep the service secure and working. That licence ends when your engagement ends, subject to the retention periods in our Privacy Policy.
We own the Platform. The software, interfaces, engine logic, scoring methodology, designs, documentation and the Brandmasters and Brandmasters GTM names and marks are ours or our licensors'. These terms grant you a right to use the Platform during your engagement, and nothing more. You may not copy, reverse engineer, resell, sublicense or create derivative works from it, or use it to build a competing product.
Aggregated, de-identified statistics that cannot reasonably be used to identify you, your company or any individual may be used by us to improve the service.
You are the sender
This matters more than anything else in this document.
The Platform does not send outreach on its own initiative. Every message waits for a human at your organisation to approve it, and every spend waits for the same approval. When you approve a message, you are the sender of record for that message.
Accordingly, you are responsible for:
- having a lawful basis to contact each recipient, and for honouring opt-outs, unsubscribes and deletion requests;
- the accuracy and the claims made in messages you approve, including any our drafting assistance proposed;
- complying with the laws that apply to your outreach, which may include the GDPR and UK GDPR, the US CAN-SPAM Act, Canada's CASL, and the marketing and privacy rules of any other market you send into;
- complying with the terms of any third-party network you reach people on, including LinkedIn; and
- the suppression lists, domains and sending identities you configure.
We provide the controls — approval gates, verification, suppression, reply detection that stops both channels — but we cannot assess the lawfulness of your outreach for you, and we do not give legal advice.
Acceptable use
Your use of the Platform is subject to our Acceptable Use Policy, which forms part of these terms. In short: no unlawful outreach, no purchased or scraped lists you have no right to use, no deceptive sender identities, no targeting of people who have opted out, and nothing that would put a shared service or a third party at risk.
Third-party services
The Platform connects to third-party services to do its work — data and enrichment providers, address verification providers, sending infrastructure and CRMs. The current list is published at Sub-processors.
Where you connect your own account with a third party, your relationship with that provider is governed by their terms, and we are not responsible for their acts, omissions, availability or pricing. We may change a provider where we need to, and we will update the sub-processor list when we do.
The Site links to third-party destinations, including our scheduling page hosted by Cal.com. Those destinations have their own terms and privacy practices.
Automated processing and drafting assistance
The Platform scores accounts automatically against criteria you set, and uses large language models to draft outreach. Scores come with written reasons, and drafts are proposals shown to a person before anything is sent.
No decision that produces a legal or similarly significant effect on an individual is made by the Platform without human involvement. You keep the final say on every account worked and every message sent.
Fees
Fees, invoicing and payment terms are set in your engagement agreement or order form, not on this page or on the Site. No pricing is offered on the Site and nothing on the Site constitutes a quotation.
Confidentiality
Each of us may receive information from the other that is confidential. Each of us agrees to use the other's confidential information only to perform under these terms, to protect it with at least reasonable care, and not to disclose it except to people who need it and are bound by similar obligations. These duties do not apply to information that is public through no fault of the recipient, was already lawfully known, is independently developed, or must be disclosed by law — and in that last case, the recipient will give notice where it is lawful to do so.
Service availability and changes
We work to keep the Platform available and will give reasonable notice of planned maintenance where we can. We may change, add or remove features. We will not make a change that materially reduces the core functionality of the Platform during a paid term without telling you.
Uptime commitments, if any, are set in your engagement agreement. The Site itself is provided as-is with no availability commitment.
Term, suspension and termination
These terms apply for as long as you use the Site or the Platform.
Either of us may terminate an engagement as set out in the engagement agreement. We may suspend or terminate access immediately for a material breach of these terms or the Acceptable Use Policy, for non-payment after notice, or where required by law.
On termination, your access ends. You may request an export of your data before the end of your engagement, and we will hold and then delete data as described in our Privacy Policy. Provisions that by their nature should survive — ownership, confidentiality, disclaimers, liability, indemnity and governing law — survive termination.
Disclaimers
The Site and the Platform are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or trade usage.
We do not warrant that the Platform will be uninterrupted or error-free, that data supplied by third-party providers is accurate or complete, that a verified address will always be deliverable, or that any particular commercial outcome — replies, meetings, pipeline or revenue — will be achieved. Outbound results depend on your offer, your market and your execution.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
Limitation of liability
To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost pipeline, lost data or loss of goodwill, however caused and on any theory of liability.
Each party's total aggregate liability arising out of or relating to these terms is limited to the fees you paid or owed to us under the engagement in the twelve months before the event giving rise to the claim.
These limits do not apply to your payment obligations, to either party's breach of confidentiality, to your indemnity obligations below, or to liability that cannot lawfully be limited.
Indemnity
You will defend and indemnify us against claims, losses and reasonable costs arising from: outreach you approved; your data and the rights you claim to it; your breach of these terms or the Acceptable Use Policy; and your breach of a law or a third-party network's terms in connection with your use of the Platform.
Changes to these terms
We may update these terms. When a change is material we will give reasonable notice — by email to your account contact, by notice in the Platform, or both — before it takes effect. The "Last updated" date at the top of this page always shows the current version. Continuing to use the Platform after a change takes effect means you accept it.
Which document wins
If there is a conflict, the order of precedence is: (1) your signed engagement agreement or order form; (2) any data processing addendum between us; (3) these Terms of Use; (4) the Acceptable Use Policy; (5) any other policy referenced here.
Governing law and disputes
[Governing law and venue to be confirmed by Brandmasters Media before publication.]
We would rather resolve a problem than argue about it. Before starting formal proceedings, each of us agrees to raise the issue in writing and to give the other 30 days to put it right.
